AppScan AI is an assistive tool. It is intended to be used in conjunction with prudent security practices and manual monitoring as part of an overall site health plan. Do not rely on it as your only means of security or availability assurance.
Acceptance of Terms
Agreement
By accessing or using AppScan AI, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use our service. By using AppScan AI, you represent and warrant that you meet these requirements.
Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of material changes via email and by posting a notice on our website. Your continued use after such changes constitutes acceptance of the new terms.
Account Responsibilities
Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized access or security breach. You are liable for all activities that occur under your account.
Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
One Account Per User
Each user may maintain only one account. Creating multiple accounts to circumvent plan limits or abuse our service is strictly prohibited and may result in immediate termination.
Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our sole discretion.
Acceptable Use
Authorized Websites Only
You may only scan and monitor websites that you own or have explicit permission to test. Unauthorized scanning of third-party websites is strictly prohibited and may be illegal.
Prohibited Activities
You may not use our service to: (a) violate any laws or regulations; (b) infringe on intellectual property rights; (c) transmit malware or harmful code; (d) attempt to gain unauthorized access to our systems; (e) interfere with other users' use of the service; (f) use the service for any illegal or unauthorized purpose.
Rate Limits
You agree to respect all rate limits and usage restrictions associated with your plan. Excessive use that impacts service performance may result in throttling or account suspension.
Compliance
You are responsible for ensuring your use of our service complies with all applicable laws, including data protection laws (GDPR, CCPA, etc.) and computer fraud laws.
Billing & Payments
Subscription Plans
Our service is offered on a subscription basis. You will be charged the applicable fee for your selected plan at the beginning of each billing cycle (monthly or annually).
Payment Processing
All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
Auto-Renewal
Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the then-current rate for your plan.
Price Changes
We may change our pricing at any time. Price changes will not affect your current billing cycle but will apply to subsequent renewals. We will notify you at least 30 days before any price increase.
Refunds
We offer a 14-day money-back guarantee for new subscriptions. After 14 days, all fees are non-refundable. Refunds are not provided for partial months or unused portions of annual plans.
Failed Payments
If a payment fails, we will attempt to charge your payment method again. If payment fails repeatedly, your account may be suspended or downgraded until payment is received.
Service Availability & Nature of Service
Assistive Tool; Overall Site Health Plan
AppScan AI is an assistive tool designed to support, not replace, your security and operations efforts. You should use it in conjunction with prudent security practices (e.g., secure development, access controls, incident response) and manual monitoring as part of an overall site health plan. It is not a substitute for human judgment, internal security programs, or other monitoring and protection measures.
Uptime
We strive to provide 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice when possible.
Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.
No Warranty
Our service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Accuracy of Results
While we strive for accuracy, we do not guarantee that our security scans will detect all vulnerabilities or that monitoring will catch all downtime. You must not rely solely on our service for security or availability. Use our outputs as one input among many in your overall site health and security strategy.
Limitation of Liability
Disclaimer
To the maximum extent permitted by law, AppScan AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
Maximum Liability
Our total liability to you for any claims arising from your use of our service shall not exceed the amount you paid us in the 12 months preceding the claim.
Security Findings
We are not responsible for security vulnerabilities found on your websites or any damages resulting from such vulnerabilities. Our service provides information only; you are responsible for implementing fixes.
Third-Party Services
We are not responsible for any third-party services, websites, or content accessed through our service. Your use of third-party services is at your own risk.
Intellectual Property
All content, features, and functionality of AppScan AI, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of AppScan AI and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our content without our express written permission.
Indemnification
You agree to indemnify, defend, and hold harmless AppScan AI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our service, your violation of these terms, or your violation of any rights of another party.
Cancellation & Termination
By You: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. You will retain access until the end of the paid period.
By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these terms. Upon termination, your right to use the service will cease immediately.
Effect of Termination: Upon termination, we will delete your data according to our data retention policy. You may request a data export before cancellation.
Dispute Resolution
Informal Resolution: If you have a dispute with us, please contact us first at support@appscanai.com. We will attempt to resolve the dispute informally.
Arbitration: If we cannot resolve the dispute informally, any dispute arising from these terms or your use of our service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as part of any class or representative action.
Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms will be brought exclusively in the courts located in Delaware.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect.
